I'm trying to add a rubric to an assignment where I can use the free-form commenting feature. However when I check the box and click Update Rubric, it doesn't save.
Why is this setting not saving? Is there something I'm doing wrong or is this an error with Canvas?

I have been able to duplicate the experience that you have described and I have reported it to Canvas Support.
I have also taken a quick look at Known Issues - Instructure Community and, at least when I checked, it was not listed.
The Tier 1 agent that I spoke with is going to contact the next level of support for assistance and for it to (most likely) be sent over to engineers so that it can be fixed.
FYI - This experience has also been reported at New Assignment Rubric Freeform Comment Issue - Instructure Community - 643725.

Hello, Our engineers have deployed a fix for this issue. Please let us know if you are still seeing this behavior or if you have any need for further support and we will diligently investigate to ensure the issue is completely resolved.
When will this be fixed - I'm grading finals - asnd use rubrics - now I will have to do 42 papers by hand with a rubric printed out - this is going to cost me two days work.

According to my records from when I reported this to Canvas Support, this specific problem (the ability to select and de-select the "I'll write free-form comments when assessing students" setting when either creating or editing/updating a rubric) has been working since Friday, May 9th at about 3:50 PM ET.
I just:
If you are not able to do that, I would recommend that you either (a) if available to you, report it directly to Canvas Support or (b) contact your institution's Canvas team so that they can report it directly to Canvas Support.

We are aware of an ongoing issue with Rubrics where certain settings do not stick after saving them and our engineering team is working on a solution.
I will attach the case to them and put your ticket On Hold, so they can update you once a fix has been deployed.
If you have any additional questions or concerns, please don't hesitate to reach back out to us.
I came across this issue on Friday, May 9. It is still not letting me save the new rubric this morning. It is just saying: There was an error saving the rubric.

After Canvas Support notified me that the issue had been resolved, I immediately:
I was able to do enable the "I'll write free-form comments when assessing students" option.
I also just tried again.
If you are not able to, I would recommend that you contact Canvas Support directly.
